The Complexity of
Construction Disputes

A construction project brings together numerous parties with divergent interests. From owners, design professionals and financiers to contractors, subcontractors and materials suppliers, each bring their own expertise to the project.

However, due to the highly complex nature of construction and the relationships between the parties, disputes will inevitably arise. Disputes arising from construction delay, cost overruns, design changes, and issues surrounding construction deficiencies, and lead to millions of dollars in damages.

How and when these disputes arise, and how they are settled may determine the ultimate success of the project.

The Role of Alternative Dispute Resolution (ADR)

Alternative dispute resolution (ADR) approaches, such as mediation, arbitration, as well as neutral evaluation of claims through a project neutral or through Dispute Resolution Boards, are effective strategies to achieve this goal. ADR provides the parties to a dispute with a more time-effective and cost-efficient process when compared to traditional litigation and provides the participants with more control over the process and the outcome.

Wise Alternative Dispute Resolution Inc., is dedicated to providing effective dispute resolution services to all stakeholders in the construction industry.

Having been involved over the past 40 years in both drafting complex project delivery agreements, as well as prosecuting, defending and resolving thousands of construction and infrastructure disputes across Canada, Howard Wise is well positioned to assist the parties in whatever ADR process they choose.
